Welcome to the BlocksAndMocs website (the “Site”). The Site, operated by BlocksAndMocs (“BlocksAndMocs”, “us”, “we”, or “our”), is provided as a service to our customers. Please review the following terms and conditions of use, which govern your use of the Site (the “Terms”).

Access to and use of the Site is conditioned upon acceptance of and compliance with these Terms. By accessing the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, then you do not have permission to access the Site. By using the Site, you represent and warrant that you are of legal age to form a binding contract or have the consent of a parent or guardian who is of legal age.

User Accounts

When you create an account on our Site, you represent and warrant that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. We reserve the right to refuse Service or terminate accounts at our sole discretion.

By creating an Account on our Site, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any or all of these communications from us by following the unsubscribe link or instructions provided in any email we send.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to restricting access to your computer or account. You may not share your account, username, or password with any other party or use the account, username, or password of any other party. You will be solely responsible for all activities undertaken and all obligations made by you or through your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar, or obscene.

To the extent that the Site allows you to link your account to any social networking or other online accounts, you may only link your own accounts. By linking your other accounts, you expressly authorize us to access your account information from those third party accounts, on your behalf as your agent, and permit us to access, use and, in some cases, store your account information.

We reserve the right to modify or suspend the Site, or any service, content, feature or product offered through the Site, or terminate your right to access or use any portion of the Site, with or without notice, at any time in our sole discretion. You agree that we shall not be liable to you or to any third party for any modification, suspension, or restriction of the Site or any portion thereof.

You agree to access or use the Site solely for legal purposes as allowed by these Terms. Amongst other things, you agree not to:

Hack into the Site, or modify another website so as to falsely imply that it is associated or affiliated with the Site;
Damage, disable, overburden, transmit any worms or viruses or any code of a destructive nature, or interfere with any other party’s use and enjoyment of the Site;
Violate any applicable laws, rules or regulations in your jurisdiction (including but not limited to trademark and copyright laws); or
Access or attempt to access any password-protected, secure or non-public areas of the Site without our express permission.

Unless otherwise noted, the Site, and all materials on the Site, including text, images, illustrations, designs, icons, photographs, and video clips, and the copyrights, trademarks, trade dress, or other intellectual property in such materials (“BlocksAndMocs Content”), are owned, controlled or licensed by BlocksAndMocs. The BlocksAndMocs brand name and logo are registered trademarks of BlocksAndMocs. The Site and the BlocksAndMocs Content are intended solely for personal, non-commercial use. You may download or copy the BlocksAndMocs Content and other downloadable materials displayed on the Site for your personal use only. No right, title or interest in any downloaded BlocksAndMocs Content is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way any of the BlocksAndMocs Content or the Site.

Any third-party content, products, or services posted on, transmitted through, or linked from the Site are the sole responsibility of the third-party originator. If you choose to access any third-party content, you do so at your own risk.
WE ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE OF ANY SORT INCURRED AS A RESULT OF ACCESSING A THIRD-PARTY WEBSITE OR ANY THIRD-PARTY CONTENT, PRODUCTS, OR SERVICES.

Content You Provide

Our Site allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“User Content”). You are responsible for the User Content that you post on or through the Site, including its legality, reliability, and appropriateness. We take no responsibility and assume no liability for User Content you or any third-party posts on or through the Site.

The Site is publicly viewable and you should have no expectation of privacy or confidentiality in any User Content you post. You agree that any User Content you post will not violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right and will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Site. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or any third parties regarding the source of any User Content. We may refuse to accept or may edit or remove User Content from the website for any reason.

By submitting User Content to the Site, you grant, and you represent and warrant that you have the right to grant, BlocksAndMocs, its affiliates, agents, and licensees, an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, reproduce, publish, distribute, sublicense, and otherwise disclose, prepare derivative works of, or incorporate into other works, the User Content, for any purpose without restriction, in any medium now known or later developed and without restriction, including without limitation in catalogs, email, social media, podcasts, videos, customer communications, store materials, trade show materials, and other public displays, without any further review or approval by or compensation to you. You agree that your User Content may be used by BlocksAndMocs either alone or in conjunction with other material, including advertisements. While BlocksAndMocs will make commercially reasonable efforts to give you credit, you agree that such credit is not mandatory and your permission for us to use your User Content is not contingent upon such credit being given.

By posting on our Site, you represent and warrant that you own all rights to your User Content or, alternatively, that you have the right to give us the rights described above and that you have paid and will pay in full any fees or other payments that may be due to third parties for your use.

Placing An Order

By placing an order with us for any product or Service made available through the Site, you represent and warrant that (i) you have the legal right to use the payment method provided, (ii) you are of legal age and capacity to form a binding contract, and (iii) all information you provide to us in connection with such order is true, accurate, and complete.

You may be asked to supply certain information relevant to any order you place through the Site including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. We may use third party services to process your payment or fulfill your order. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per account, per IP address, per billing information, per postal address, per credit card or per order. If we make a change to or cancel an order, we will attempt to notify you. We further reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

All features, specifications, products, prices, discounts, promotions, and offers described on our Site are subject to change at any time, without notice. We have made every effort to accurately display our products, but images on the Site may not exactly match the actual product. All prices displayed on the Site are in EUR (€) unless otherwise noted. We will add applicable sales taxes and shipping fees as necessary. The risk of loss and title for products purchased pass to you upon our delivery of the products to the carrier.

Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Sites is inaccurate at any time without prior notice (including after you have submitted your order).

Order Cancellation

Our products, along with all associated ancillary items, is custom-manufactured specifically upon placement of the order, therefore, cancellation will be available only within 72 hours from the time the order is placed.
After this period, you will no longer be able to cancel your order.

Shipping & Delivery

Shipping Information:
To prevent fraud, we will only ship the item(s) to your billing address. During payment processing, the billing address is verified against the payment details. If the address does not match, the payment will be declined, and the order will not be completed.

If paid with PayPal, we will ONLY ship the item to the shipping address listed on the “Transaction Details” page for the transaction in your PayPal account.

BlocksAndMocs prioritizes the protection of its customers’ financial information. To enhance security, we ship orders only to the billing address provided. If you prefer to have your order shipped to a business address, please include your business name along with the address information. Otherwise, we will automatically ship the item to your billing address.

Please be aware that by authorizing delivery to an address, you are permitting anyone at that address to sign for your package, and by completing the authorization form, you are waiving certain rights. Ensure you trust the individuals at the delivery address. If the shipment needs to be returned or exchanged, only the original customer can arrange this, regardless of who signed for the package.

BlocksAndMocs cannot accept P.O. Box addresses as valid shipping addresses. Additionally, we do not ship to freight forwarding addresses or hotels. Please ensure your order is shipped to a tangible, physical address.

While we ship items worldwide, there are some countries where we are unable to send shipments due to various reasons.

BlocksAndMocs selects the most suitable carrier to ensure your collectible is delivered safely and efficiently while keeping shipping costs as reasonable as possible. For international shipments, we prefer using DHL to provide the best service.

Package Refusals:
BlocksAndMocs does NOT recommend refusing the delivery of purchased goods under any circumstances (that applies to any company, but especially when it comes to us)!

We have specific procedures in place to assist you with the easy return and exchange of an item only in case your item is defective or wrongfully sent. Refusing a package will only lengthen the amount of time it will take to bring you a satisfactory resolution, and create further problems for you.

Packages Returned By The Carrier:
Packages that are returned to BlocksAndMocs by a shipping carrier due to an incorrect or incomplete shipping address will not be re-shipped to the collector. They will be checked into our warehouse and a refund will be issued less the return shipping costs, international return fees, and applicable taxes.

Items returned to us may be put back into our inventory to be offered to other collectors interested in that specific item.

If Your Package Arrives Damaged:
Even if the package arrives damaged, please accept it and contact us immediately! We may be able to assist you with a quick resolution without the need to return the damaged item to our warehouse.

For Customers Outside Of The EU And The EEA:
Any item that is shipped internationally from BlocksAndMocs will cost additional customs import fees and taxes for that are assessed upon delivery. The taxman comes for all of us, no matter where we live!

Customers are responsible for paying these fees directly to the carrier. We strongly suggest that you contact your local customs office to verify the duty rate prior to making your purchase so that you have no problem paying these fees.

These fees – whatever the assessment rate may be – are not a valid reason for refusing or returning a package and will not be covered by BlocksAndMocs’s Return and Exchange Warranty. In addition, any international deliveries that are refused will have those fees and taxes deducted from the refund due upon the item’s return.

Any items that are abandoned by the carrier and not returned to BlocksAndMocs will be considered lost and no refund will be issued. Please know that any international purchases that are refused/abandoned could result in permanent account closure.

Returns & Refunds

As our products are customized and made in small batches, we do not accept returns.
All sales are final except in the case of defects or an error on our side. If your item is defective or wrong item was shipped, we will gladly replace it. In the case that replacement isn’t possible, we will issue a full refund for the item.

Import Duties & Taxes

For EU and EEA (Iceland, Liechtenstein, Norway) Countries:
All our products are manufactured and shipped from Germany, and as such, shipments to EU and EEA countries are typically free from customs duties. Within the EU and EEA, the single market facilitates the free movement of goods without additional customs fees or taxes.

For International Customers Outside The EU & EEA:
Customs fees, sales taxes, etc., are NOT included in your purchase price and may be charged by your country’s customs office. In some cases, these duties and customs fees are collected by the carrier.

We DO NOT collect Duty / VAT directly and therefore those fees are NOT INCLUDED in your order total. Customers outside of the EU & EEA are responsible to pay Duty and VAT directly to the carrier at the time of delivery or via bill/invoice afterward.

The Customs Tariff Number, also known as the Harmonized System (HS) code, for LEGO® sets typically falls under the category for toys and games.
The specific HS code for LEGO® products is generally: 95030035 – This code is used for “Toy construction sets” including LEGO®.
You should verify the duty rate with your local customs office before placing your order.

It is YOUR responsibility to investigate the amount of taxes and duties you will owe prior to your shipment. BlocksAndMocs uses the harmonized code that we have been told is appropriate for the shipping of our products to your region, but your customs office has the power to change this code on its own. We don’t want an international incident, so we’re not going to argue with them.

If you feel that your final code/tax is not correct, then you can contact the carrier and/or your customs office directly to request a review. If a package is refused due to excessive import fees and duties, you will be responsible for any return shipping fees that the carrier will charge BlocksAndMocs to return the package. If Sideshow is unable to have the item returned due to a package refusal, a refund will not be issued.

Disclaimer Of Warranties And Limitation On Damages

THE SITE AND PRODUCTS ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS, DISCLAIMING ALL WARRANTIES, INCLUDING SPECIFICALLY THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ASSUME NO LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, PRODUCTS OR ANY THIRD PARTY WEBSITE(S) OR PRODUCTS, OR FOR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE.

BlocksAndMocs its subsidiaries, affiliates, and its licensors do not warrant that: a) the Site will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Some states or jurisdictions do not allow the limitation or exclusion of certain warranties, or the exclusion or limitation of certain damages. If you reside in one of these states or jurisdictions, the above limitations or exclusions may not apply to you.

In no event shall BlocksAndMocs, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use ,or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

We collect various information on our behalf from and about you, including information you directly provide when you use the Messaging Service. For example, we collect the phone number and/or email address you provided when signing up for the Messaging Service. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages. We may also collect information about you using cookies or similar technologies. Cookies are pieces of information that are stored by your browser on the hard drive or memory of your device. Cookies enable personalization of your experience on the Messaging Service. You shall defend, indemnify, and hold harmless, BlocksAndMocs, its affiliates, and each of its and its affiliates’ employees, contractors, directors, suppliers, agents, and representatives from all liabilities, claims, and expenses, including reasonable attorneys’ fees and other legal costs, that arise from or relate to (i) your use or misuse of the Site; (ii) violation of these Terms; (iii) infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity; or (iv) any User Content you submitted. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in asserting any available defenses.
